Company A business that uses or subscribes to our Software.
Controller A “Controller” under the CCPA/CPRA or a “Processor” under the GDPR and US state privacy laws.
End Users Users who login and access our Software, typically authorized employees of a Company.
Customers Individuals who are interfacing with a Website or a Product, for example, people shopping in an online e-commerce store that is powered by our Software.
Personal Information Any information relating to an identified or identifiable individual.
Product A solution created by a Company using our Software, for example, an online e-commerce store, presentation, quote, or website.
Service Provider A “Service Provider” under the CCPA/CPRA or a “Processor” under the GDPR and US state privacy laws.
Software Our software that is available to authorized users for login either on our website or another URL.
Website The website or web-enabled software product upon which this privacy policy is posted.

2. How We Collect Personal Information. We collect Personal Information in the following ways:

  • Directly from you when you provide such information directly to us, for example, when you sign up for an account or enter into a transaction on a Store.
  • When you browse our Website or interface with one of our Products, we or third-parties we work with, automatically collect certain information using online tracking technologies such as pixels, web beacons, and cookies.
  • From End Users of our Software who access it for business purposes on behalf of a Company. Information about how we process this information can be found in our End User Privacy Policy at https://ordermygear.com/end-user-privacy/.

3. Personal Information We Collect About You. We may collect and use the following Personal Information:

Employment Information Information you provide as part of applying for a job or during the course of your employment. To assess your eligibility for employment, onboard and enroll you as an employee, evaluate your performance, operate our business, comply with laws, communicate with you, and to provide you with compensation and benefits.
Identifying Information Name, email address, postal address, phone number, date of birth, and similar identifiers. To provide our services to Companies and to assist with fulfilling orders and related transactions like returns that are powered by our Software.

We may also use it to prevent and detect fraud, for auditing and investigatory purposes, and to comply with professional, legal and regulatory obligations that apply to us; for operational reasons, such as improving efficiency, training and quality control, for analysis to help us manage our business, e.g. in relation to our financial performance, to prevent unauthorized access and modifications to systems.

Technical Information IP address and products you have viewed or searched for while using our Websites or a Product. Although we do not normally use technical data to identify individuals, sometimes individuals can be recognized from it, either alone or when combined or linked with user data. To market our services and determine the effectiveness of our marketing.
Website Submissions Information you submit to us from online forms on our Website, which may include your name, e-mail, telephone, company name and chat records from the use of the chat tool on the Website. To respond to inquiries from you and assist you in resolving issues.

Website Tracking Technologies. When you visit our Website, we or third-parties we work with (like advertising networks, analytics providers, and social media platforms and networks), may collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third–party libraries, and cookies (collectively, “Tracking Technologies”). These Tracking Technologies only collect your Personal Information when you consent by clicking your preference on the Privacy Banner that is displayed on our Website.

The Website Tracking Technologies we use include:

  • Necessary Cookies that enable the basic features of the Website, such as providing secure log-in or adjusting your consent preferences. These cookies do not store any Personal Information.
  • Functional Cookies that help perform certain functionalities like sharing the content of the website on social media platforms, collecting feedback, and other third-party features.
  • Performance cookies that we use to understand and analyze the key performance indexes of the website which helps in delivering a better user experience for the visitors.
  • Advertisement cookies that are used to provide visitors with customized advertisements based on the pages you visited previously and to analyze the effectiveness of our ad campaigns. This information may include your IP address, browsing history, and device information. Depending on your preferences, it may be shared with third-party advertising providers like LinkedIn and Google.
  • Uncategorized cookies that are being analyzed and do not belong to any of the categories listed above.

Once you select a preference on the banner, you can view the information or modify your cookie preferences and opt-out of the collection, sale, or sharing of this information by clicking the “Consent Preferences” icon displayed in the bottom left-hand corner of our website.

4. Who We Share Your Personal Information With.

Information We Collect from Customers

  • Payment Information and Identifying Information with the Company that created the Product, for example, a Company that uses our Software to create an online e-commerce store that it uses to sell items to Customers.
  • Payment Information, Identifying Information, and Technical Information is shared with our Service Providers or those of the Company.

Information From Website Visitors.

  • Employment Information, Technical Information, and Website Submissions are shared with our Service Providers and Affiliates.

General Information Sharing. We may also share Personal Information with:

  • External auditors;
  • Law enforcement agencies;
  • Courts as required by a court order or required by litigation; 
  • Regulatory bodies to comply with our legal and regulatory obligations; and
  • Companies that use our Software as described in our End User Privacy Policy at https://ordermygear.com/end-user-privacy/.
  • Other parties, such as potential buyers of some or all of our business or during a re-structuring. In this event, we will typically anonymize information, but this may not always be possible.  The recipient of the information will be bound by confidentiality obligations.

(a) Mobile Information. Notwithstanding the foregoing, we do not share mobile telephone numbers or opt-in data and consent with third parties or affiliates for marketing/promotional purposes.

(b) Sales of Personal Information.Some jurisdictions consider the sharing or disclosing of Personal Information collected by online tracking technologies like cookies with third-parties to be a “sale” of Personal Information. To the extent this information is considered a sale, we share some Personal Information gathered when you browse our website with third-parties to process it to deliver content or advertisements that are more relevant to your interests. In some states, our disclosure of End User Personal Information between the companies that use our Software may constitute a “sale.” Information about the processing of this information can be found in our End User Privacy Policy at https://ordermygear.com/end-user-privacy/.

(c) Disclosure of Personal Information for Business Purposes. We have disclosed the categories of personal information as listed above for business purposes to the following categories of parties within the last 12 months:

  • Our Affiliates and Service Providers, to help conduct our business such as providing our products and services, supporting our everyday operations, marketing, business development and management. These may include payment processors, cloud storage providers, fulfillment providers, security vendors, email providers, and data analytics companies.
  • The Companies with whom you enter into transactions or that create Products that you interact with that are powered by our Software.

5. Global Privacy Control.We honor Global Privacy Control, a browser-level signal, maintained either by a browser or browser extension, that a user can configure to opt out of the sale or sharing of Technical Information we collect using cookies with third-parties. 6. How Long Your Personal Information Will Be Kept. We will keep your Personal Information for the period necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law.

We will also keep your Personal Information for as long as is necessary:

  • To respond to any questions, complaints or claims made by you or on your behalf;
  • To show that we treated you fairly; or
  • To keep records required by law.

When it is no longer necessary to retain your Personal Information, we will delete or deidentify it.

 

7. Where Your Personal Information is Held. Information may be held in the at our offices, those of our Service Providers, and third parties.

 

8. IMPORTANT NOTICE FOR CHILDREN UNDER THE AGE OF SIXTEEN (16). Our Website and Services are NOT intended for children under the age of 18 without parental consent. Indeed, our Terms of Service (in Paragraph 3) includes a warranty that you are at least 18 years of age or have the consent of a parent or guardian authorizing you to use our Services.  IF YOU ARE UNDER THE AGE OF 16 and wish to use our Services, your parent or legal guardian must supervise your use of our Website and Services, opt-in and create any account, submit any of your Personal Information, and agree to this Policy, and our Terms of Service Agreement for you and your parent or legal guardian.  Also, WE WILL NOT RETAIN ANY PERSONAL INFORMATION OF ANY PERSON UNDER THE AGE OF THIRTEEN (13) IF KNOWINGLY COLLECTED WITHOUT PARENTAL OR LEGAL GUARDIAN SUPERVISION AND CONSENT. If we learn that we have collected Personal Information from someone under the age of 13 that was not provided with the supervision and consent of the minor’s parents or legal guardian, we will promptly delete that Personal Information. If you believe we have impermissibly collected Personal Information from someone under the age of 13, please contact us immediately.

9. Your Rights to Your Personal Information

For You if You Are in the EEA, the UK, or Switzerland.

We do not offer our Services to Companies in the EEA, the UK, or Switzerland. However, in the event that a Company uses our Software to create a Product that collects Personal Information from a data subject in the EU, UK, or Switzerland, the Company is the Controller of the data and we are the Processor and process the data in accordance with their documented instructions. In other instances, Personal Information may be collected when a resident of these jurisdiction visits our Website. We process Personal Information on the following legal bases: consent; as necessary to perform our agreement to provide services or other applicable agreements; as necessary for compliance with a legal obligation to which we are subject; or as necessary for our legitimate interests and the Companies who use our Software.

Residents of the  EEA, UK, or Switzerland have the following rights.

Right to Lodge a Complaint Users that reside in the EEA, the UK, or Switzerland have the right to lodge a complaint about our data collection and processing actions with the supervisory authority concerned. Right to Independent Dispute Resolution Body Designated to Address Complaints and Provide Appropriate Recourse Free of Charge to You We commit to resolve complaints about privacy and its collection or use of your Personal Information. European Union or Swiss individuals with inquiries or complaints regarding this Policy should first contact Us at privacy@ordermygear.com. If we are acting as the Processor pursuant to instructions from a Controller, it may refer you to the applicable Controller to exercise your rights with respect to the data we are processing on its behalf.

Furthermore, we have committed to refer unresolved privacy complaints under the Privacy Shield Principles to JAMS (Judicial Arbitration & Mediation Services), an independent alternative dispute resolution provider located in the United States and recognized for this purpose by the U.S. Department of Commerce.   • The categories of sources from which the Personal Information is collected;
  • Our business or commercial purpose for collecting or selling Personal Information;
  • The categories of third parties with whom we share Personal Information, if any; and
  • The specific pieces of Personal Information we have collected about you.

Please note that we are not required to:

  • Retain any Personal Information about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained;
  • Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered Personal Information; or
  • Provide the Personal Information collected to you more than twice in a 12-month period.
Personal Information Sold or Used for a Business Purpose In connection with any Personal Information we may sell or disclose to a third party for a business purpose, you have the right to know:

  • The categories of Personal Information about you that we sold and the categories of third parties to whom the Personal Information was sold; and
  • The categories of Personal Information that we disclosed about you for a business purpose.
Right to Opt-out You have the right to opt-out of the sale of your Personal Information to third parties or Service Providers, the use for targeted advertising, and profiling in furtherance of a decision that produces a legal or similarly significant effect concerning you. If you exercise your right to opt-out, we will refrain from selling your Personal Information, unless you subsequently provide express authorization. We may deny the request if the information is necessary to: 

  • Complete providing a Service requested or reasonably anticipated by the Opt-In Participant 
  • Detect and protect against security incidents, malicious, deceptive, fraudulent, or illegal activity, or take action against those responsible for such activity 
  • Debug to identify and repair errors impairing intended functionality
  • Engage in research in the public interest adhering to applicable ethics and privacy laws where the Opt-In Participant has provided informed consent 
  • Enable solely internal uses reasonably aligned with the Opt-In Participant’s expectations based on the Opt-In Participant’s relationship with us
  • Comply with any legal proceeding, court order, law, legal investigation, regulatory body, or other legal obligation
  • Otherwise use the information internally in a lawful manner compatible with the context in which the Opt-In Participant provided the information
Right to Restriction of Processing The right to require us to restrict processing of your Personal Information—in certain circumstances, e.g. if you contest the accuracy of the data
Right to Data Portability The right to receive the Personal Information you provided to us in a portable and readily usable format. If the Personal Information is in a platform, you may have the right to receive the information in a format that allows the transfer to another platform.

  • In certain other situations to our continued processing of your Personal Information, e.g. processing carried out for the purpose of our legitimate interests

Right Not to Be Discriminated Against You have the right to not be discriminated against by us because you exercised any of your rights. This means we cannot, among other things:

  • Deny goods or services to you;
  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • Provide a different level or quality of goods or services to you; or
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we may charge a different price or rate or provide a different level or quality of goods and services to you, if that difference is reasonably related to the value provided to our business by your Personal Information.

Right to Appeal the Denial of an Enforcement of Your Right by Us You have the right to appeal the denial or failure to enforce any request of your rights listed above by us.

Not all of the rights listed above may apply to you depending on your state of residence and other factors, including restrictions on the number of times per year you can make certain kinds of requests. We reserve the right to evaluate your request to determine our responsibilities for complying with the request.

If you choose to contact us, you will need to provide us with:

  • Enough information to identify you (e.g., your full name, address, and email address);
  • Proof of your identity and address (e.g., a copy of your driving license or passport and a recent utility or credit card bill); and
  • A description of what right you want to exercise and the information to which your request relates.

Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification. We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person’s behalf.

10. E-mail and Text Communications

We may use your personal information to send you updates or communications by email, text message, telephone or post about our services, including exclusive offers, promotions or new services.

We have a legitimate interest in processing your personal information for promotional purposes. This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly.

You have the right to opt out of receiving promotional communications at any time by contacting by using the “unsubscribe” link in emails or “STOP” number in texts.

We may ask you to confirm or update your marketing preferences if you instruct us to provide further services in the future, or if there are changes in the law, regulation, or the structure of our business.

11. Changes to this Privacy Policy. We may change this Policy from time to time. We will provide applicable notice of changes or updates to this Policy that reflect a substantial or material change to this Policy. We will send such notifications before the changes to this Policy take effect.
